Привожу текст контракта, предоставленный Владимиром Семеновым (Sima). Сам контракт также выложен на сайте в виде документа Microsoft Word: contract_example2.doc.


Employment Agreement

This Employment Agreement is made and entered into as of _______ in Seoul, Korea by and between _______, duly organized and existing under the laws of the Republic of Korea, located in _______________ (hereinafter called “Employer”) and Mr./Ms._________ whose permanent address is ______________ (hereinafter called “Employee”).

1. Employment

1-1. Employer has agreed to employ Employee as ___________ and Employee accepted such employment upon the terms and conditions hereinafter set forth.

1-2. Employee shall prepare the required documents to Employer in order to acquire the legal visa status relevant for employment in Korea. And Employer shall present all necessary documents to Korean Immigration Office according to the Korean laws and regulations, which should be prepared or submitted by Employer itself. Without the legal visa status, this employment will be automatically withheld.

2. Duties of Employee

2-1. During the term of this Agreement, Employee will perform his/her duties to the best of his/her ability and will comply with the directions of Employer.

2-2. At all times, during the term of this Agreement, Employee will directly adhere to and obey all the rules and regulations that have been established by Employer for the conduct of Employee.

3. Terms of Agreement

3-1. The term of this Agreement shall be twelve (12) full consecutive months commencing from the date of Employee’s arrival in Korea unless terminated prior to the date of expiration for any of the reasons described herein.

3-2. This Agreement can be extended for any period of time, which is agreed on by both parties. Both parties must also agree on any change or modification of the term and conditions. Extension must be negotiated no later than 30 days prior to the date of expiration.

4. Compensations and Other Treatment of Employee

4-1. Salary

Employer will pay Employee as compensation for all services rendered the aggregate monthly salary of USD ______ for each month of the contract period with Employer. Payment for part of a month of employment will be calculated on the number of days employed. Payment of the aforesaid salaries will be made in Korean Won. Tax will be deducted about 4% from his/her salary.

4-2. Housing

Employer shall provide Employee with a furnished apartment (or to be shared with another employee). And Employer shall pay all rental fees including the charge of electricity and water.

4-3. Transportation

Employer will purchase for Employee an economy class airline ticket from the point of hire for passage on scheduled airline to Korea and the return ticket will be provided at the time of completion of this Agreement.

4-4. Working Hours and Paid Vacation

Employee’s normal working hours and days will be _____ a.m. to ______ p.m. from Monday through Friday. Should it be necessary sometimes, Employee may agree to work overtime to a certain extent. And Employee will receive ____ paid vacation days during the contract year. Vacation can be decided in consultation with Employer.

4-5. Medical Insurance

Employee will be covered by medical benefits under the Korean Medical Insurance Union, a Governmental Orgarnization. The cost of this coverage will be born in half by Employee and Employer will cover the remaining part. The payment will be made through a monthly deduction from Employee’s salary. Presently the cost approximately amounts to 1.5% of monthly salary for Employee.

5. Dismissals or Voluntary Resignation

5-1. Employer will have the right to dismiss Employee for clear and frequent neglect of duties under this Agreement, including frequent absences from the place of employment without approval of Employer, or for manifest inability to perform his/her duties. In case of dismissal, Employee will be warned of dissatisfaction with performance and will be afforded at least twenty (20) days notice during which he/she can remedy the situation.

5-2. In the event that Employee is dismissed for any of the reasons set forth in paragraph 5-1 hereinabove or in the event that the Employee voluntarily resigns prior to the completion of this Agreement, Employer will have no duty and will not be obligated to pay the cost of return airline ticket.

6. Confidentiality

6-1. Any information Employee obtains in the course of his/her duties or otherwise through Employee’s employment shall be held in the strictest confidence by Employee. Any breach of such confidentiality shall be deemed to be a breach of this Agreement and render Employee subject to summary dismissal.

7. Other Employment Conditions

7-1. Employee agrees to be bound by, and to comply with, the work rules that Employer may adopt in accordance with the Labor Standards Law of Korea. All matters not addressed in this Agreement or Employer’s work rules will be solved according to the Labor Standards Law of Korea.
